The brief strengthens family involvement by clarifying how crisis communication should operate across two separate federal privacy frameworks: HIPAA for hospitals, clinics, police, and crisis responders, and FERPA for public schools and universities. By distinguishing these legal boundaries, FRM² provides lawmakers with a legally sound statewide model that protects families while respecting federal privacy law.

Representative Byrnes' HB 2512 shifts Missouri toward a predictable-harm standard, allowing earlier intervention before tragedy occurs. FRM² expands this foundation by proposing unified statewide protocols that ensure families are notified during psychiatric emergencies, repeated crisis holds trigger state-level review, and Missouri's hospitals, schools, and correctional facilities follow consistent crisis-care standards.

Key proposals in FRM²'s brief include: Emergency Family Notification using HIPAA caregiver exceptions; Cross-System FERPA Coordination through the Health or Safety Emergency Exception; Mandatory State Intervention after repeated crisis holds; Police and Correctional Stabilization Units — establishing dedicated mental-health crisis response teams within police departments and clinically supervised stabilization units inside Missouri jails and prisons to ensure individuals in psychiatric crisis receive immediate treatment rather than punitive custody; Workforce Modernization through Medicaid payment reforms; and Inpatient Capacity Expansion using a Missouri Section 1115 Waiver.

FRM² also submitted a Missouri Case Study Attachment documenting real incidents where families were excluded from crisis decisions or individuals cycled through ERs, schools, and jails without stabilization. Each case demonstrates how FRM²'s dual HIPAA/FERPA clarifying standards could have prevented harm.
